The natural monument 2 oaks (Arnsberg-Bruchhausen) is located in Bruchhausen in the urban area of Arnsberg . The trees were designated in 1998 by the district council with the landscape plan Arnsberg by the Hochsauerlandkreis as a natural monument (ND).

At the time of designation, the two oaks were on the eastern edge of Bruchhausen on the edge of grassland. The two oaks have a trunk diameter of approx. 90 cm.

One of the oaks is on the edge of a parcel on Am Deinscheid street that was used as a playground by the city of Arnsberg. The city sold this property to a private individual. This private person applied for a building permit from the city for the construction of a residential building. The city had previously approved the area for development under planning law. Since the oak was designated as a natural monument in 1998, an application for an exemption from the prohibitions of the Arnsberg landscape plan had to be applied for from the Lower Nature Conservation Authority (UNB) of the Hochsauerlandkreis . It is forbidden to fortify the eaves area of ​​a natural monument or to carry out embankments, backfills, excavations, excavations or other changes to the soil structure in the area of ​​a natural monument.

The original plan was to build a large single-family home with a detached garage . The garage should be only three meters from the natural monument in the eaves area. After contacting the UNB, a smaller house was to be built and the garage was to be built on the side of the house facing away from the ND. Furthermore, only the side of the house facing away from the ND should be built with a basement, while the other side should be elevated to leave the ground around the ND unchanged. The UNB considered the building of a house to be approved in the newly applied for. The nature conservation advisory board of the Hochsauerlandkreis, which has to agree to special permits in landscape planning areas, lodged an objection. The nature conservation council assumed that roots and branches would definitely be damaged during the construction. This would mean that the ND would be felled in a few years for reasons of traffic safety . According to the State Nature Conservation Act of North Rhine-Westphalia, the Arnsberg District Government, as the higher nature conservation authority, has to decide if the Nature Conservation Council objects . In this case, the Arnsberg district government is responsible.

Eaves area

The eaves area of ​​a tree is the extent of its crown or how far the branches projected onto the horizontal floor area around the tree trunk. As a rule, the preservation of a tree is only guaranteed if interventions in the ground are carried out at a distance of at least 1.5 meters from the eaves.
