Non-lieu (France)

In French criminal procedure law, the ordonannce de non-lieu refers to the decision to discontinue the proceedings by the juge d'instruction (investigating judge) according to Art. 177 CPP . The setting can be for factual (non-lieu par des raisons de fait ) as well as for legal reasons (non-lieu par des raisons de droit) .

A non-lieu par des raisons de fait has limited legal force (chose jugé). A new admission is only possible under the following conditions (Art. 188 to 190 CPP):

  • The existence of new facts,
  • Getting the ministère public to submit an application for réouverture part les charges nouvelles to the responsible public prosecutor's office and
  • confirmation by the investigative court that the facts are new.

Cross-border the decision of the non-lieu is particularly relevant for Article 54 of the Schengen Implementation Convention (SDÜ).
