Open Data Commons

Open Data Commons ( ODC ) is a project of the Open Knowledge Foundation (OKF). The project deals with legal issues relating to open data / databases and provides license agreements for open data.

A license generator is provided on the project website, which can be used to generate customized license agreements for open data.

So far, three different licenses have been published, which have their counterparts in the Creative Commons licenses.

history

The Talis company and the Creative Commons Science Commons project worked together to create the legal requirements for the creation and use of open data. In this context, Jordan Hatcher (“opencontentlawyer”) and Charlotte Waelde from the University of Edinburgh developed the Public Domain Dedication and License (PDDL) from the Talis Community License.

In order to support this development and to maintain these and other licenses, the Open Data Commons project was started in autumn 2007 within the non-profit Open Knowledge Foundation (OKF). ODC licenses are based on the Open Knowledge Definition (based on the Open Source Definition of the OSI) and work from the Creative Commons project.

In an intensive exchange with the OpenStreetMap project, the copyleft license Open Database License (ODC-ODbL) was developed, which was published in 2009. The ODC Attribution License was derived from this. A draft of the Attribution License was published for the first time on January 11, 2010, and the final version on June 24.

Licenses

Data / databases are regulated internationally as intellectual property with different regulations and laws. While copyright law contains the relevant regulations for software and content , additional or completely different regulations are decisive for databases. In the EU, for example, there is a special database directive, while in the USA the copyright for databases does not apply at all.

For this reason, the ODC licenses license the copyright, special database rights , patent rights and trademarks .

The ODC licenses are special data / database licenses for which, if necessary, independent conditions can also be set for the content contained in the correspondingly licensed databases .

Public Domain Dedication and License (PDDL)

With this license, all copyrights to data / a database are waived (analogous: CC0). The PDDL implements the Science Commons Protocol for open access data.

Attribution License (ODC-By)

This license allows sharing and editing of data / databases for any purpose. As a condition for the ODC-By license, the name of the author of the work is required (analogous: CC BY ).

Open Database License (ODC-ODbL)

The ODC-ODbL license allows sharing and editing of data / databases for any purpose. As conditions, the naming of the authors of the work and the provision of the new work under the same license (analog: CC BY-SA ) are required .

OpenStreetMap uses the ODbL as a well-known project . On September 12, 2012, the change from the previously used CC BY-SA license to the ODbL was declared complete.

Other users are, for example, Open Corporates, OpenSpending, FarmSubsidy and Open Food Facts .
