Local appointment

The indefinite legal term “ local appointment” or “on-site appointment ” refers to a court hearing that takes place outside the actual court where the court usually sits ( § 219 ZPO ). The reason for such an on-site appointment is usually the judicial inspection of a certain location as part of a court case , for example at the scene of the crime or the place of the event. Its admissibility is linked to special requirements. The court has simplified options for rejecting this type of gathering of evidence in order to be able to limit tactically motivated forcing the court to attend such complex appointments outside the home.

In addition to the above meaning, the term on-site appointment is used in another. This means the time of an agreed or fixed meeting at a certain place for an official occasion. For example, experts arrange on-site appointments with those involved in the proceedings to establish facts (inspection) in a court case. The knowledge gained in this way is often incorporated into an expert report . An examination of a witness at his place of residence is also referred to as an on-site visit.

In Austria the term “local inspection” is also used.

The court day (session day) must be distinguished from a local or on-site appointment .
