Legal Services Register

The legal services register is a register that can be viewed free of charge by everyone , in which all persons who are authorized to provide legal services in Germany are recorded by name, content and the scope of their permission .

purpose

The register is used purely for information. No fee is charged for viewing ( Section 16 (1) RDG ).

It enables a quick, unbureaucratic insight via the Internet to which persons - provided they are subject to the registration obligation - to what extent the provision of legal services has been allowed. It is also possible to see which persons without a registration obligation have been prohibited from providing legal services.

Entries

Registered persons

Persons subject to registration (excluding debt collection companies , pension advisors and legal service providers under foreign law) are entered by name, if necessary with details of the legal representative and the registration court and registration number. The relevant supervisory authority , the date of the entry, the year of establishment, all addresses, which natural person has the qualifications necessary for the provision of the respective legal services, for which (sub) areas a permit is available, any conditions , any time can always add the entry Restriction and the permissible job title can be found (Section 16 (2) No. 1 RDG). In addition, telephone number and e-mail address can be given (Section 16 (2) sentence 2 RDG). The publication takes place immediately ( § 8 Abs. 2 Satz 1 RDV ).

Holders of an old permit to handle third-party legal matters are also required to register, including legal advisers ( § 1 RDGEG ).

The entry will be deleted in the event of death (natural persons) or termination (legal persons and companies without legal personality), waiver, withdrawal / revocation (at the moment of finality), in the event of prohibition (at the moment of finality) and in the event of any time restriction after a Year after the expiry of the permit ( Section 17 Paragraph 1 No. 1–4, 6 RDG). Deletions take place immediately ( § 9 Abs. 1 RDV).

Prohibitions

Anyone who has been prohibited from providing legal services regardless of a registration obligation will be entered by name, possibly with details of the legal representative as well as the registration court and registration number. The prohibiting authority, the date of the entry, the year of establishment, the address and the duration of the prohibition can always be taken from the entry (Section 16 (2) No. 2 RDG). The publication takes place immediately (§ 8 Abs. 2 Satz 1 RDV).

The entry is deleted in the event of death (natural persons) or termination (legal persons and companies without legal personality) and after the prohibition has expired ( Section 17 (1) No. 2, 3, 5 RDG). Deletions take place immediately (§ 9 Abs. 1 RDV).

Search criteria

The search works exclusively using the criteria federal state , competent authority , file number , date of entry, permission area (debt collection company, pension adviser and legal service provider in a foreign law as well as previous license holder), name and address. Complete information is not required (Section 8 (1) RDV).

privacy

The public announcement takes place exclusively via www.rechtsdienstleistungsregister.de, whereby the data protection responsibility lies with the authority responsible for the registration or the prohibition (§ 16 Abs. 3 Satz 1, 2 RDG).
