Register court

In German law , the register court is the term used for local courts that keep the following registers :

Commercial, cooperative, association and partnership registers are now kept in electronic form and mostly concentrated at the local court that has its branch at the seat of the responsible regional court . Property law registers are usually kept at the locally responsible local court.

The register is kept by entering registrable legal changes and facts as well as their deletion ; Entry and deletion are only carried out on the basis of a notarized registration. Entries or deletions ex officio, however, are rather rare.

In keeping the registers, the respective material law ( commercial code , civil code , cooperative law , partnership law , transformation law ) applies. In addition to the law on the procedure in family matters and in matters of voluntary jurisdiction (FamFG), the procedure itself is based in particular on the specific statutory ordinances (e.g. commercial register ordinance or association register ordinance ).
