The aim of the travel safety ( English travel security ) is to provide an increased deviating from the normal living environment life risk during a business trip to minimize. This requires both preventive measures before the business trip and operational support for the traveler during the business trip. The legal basis is anchored in the German Civil Code and the occupational safety laws and regulations. The employer's duty of care is offset by the employee's duty to cooperate. Basically, travel safety is about avoiding, reacting to and dealing with dangerous situations. The precautionary measures must be differentiated according to the type of trip.

shape

While on private trips ( vacation trip ) the travelers themselves take care of their own safety ( safety instructions from the Federal Foreign Office ), the situation is different for a business trip ( posting ). Here employers are obliged to ensure the well-being ( safety and health ) of their employees ( employer's duty of care ).

Employer's duty of care

Before, during and after the business trip / posting, the appropriate and necessary measures for the safety of the traveling employees must be taken. The principle of proportionality must be observed here. Ie the employer's duty of care is all the greater

  • the greater the difference in political, cultural or social nature
  • the more dangerous the dangers and the living conditions, acc. the risk assessment

are in the travel destination.

The employer bears the liability risk. The employees have an obligation to cooperate.
In Germany, the duty of care results from §§ 241 Abs. 2, 617–619 BGB as a secondary duty from the employment relationship. Furthermore, there are obligations from the Occupational Safety and Health Act (ArbSchG). The liability for damages results from § 280 BGB. The employer's obligations on a business trip can be fulfilled as part of the preparatory protective measures.

In addition to safety prevention for travelers, preventive health care and medical care in the country of travel should also be considered. This includes medical country information, such as the risk of infection, existing diseases, the resulting necessary vaccinations, and instructions on how to behave in the event of medical emergencies.

A travel warning from the Federal Foreign Office helps with the assessment of security in the country of travel .

A 24/7 emergency number should be available to travelers for difficulties and emergencies abroad . Due to the time differences when traveling abroad, a traveler who is in danger cannot reach his contact person in Germany. Assistance service providers offer such emergency numbers.
