The marine environmental behavior regulation applies to all ships on sea waterways and in the exclusive economic zone of the Federal Republic of Germany. The regulation also applies to ships flying the German flag that are not in German territorial waters, unless other regulations apply in territorial waters or in the exclusive economic zones of other countries. The requirements of Directive 2012/33 / EU (Sulfur Directive) are implemented in German law through the Marine Environmental Behavioral Ordinance.

The ordinance was issued in 2014 by the Federal Ministry of Transport and Digital Infrastructure (BMVI) and the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety (BMUB).
