State form feature
State form features is a term from constitutional law and general political theory . In German constitutional law, the synonyms state structure principle and constitutional basic decision are more common. Characteristics of the form of government are characteristics that define the elementary characteristics of the state community and determine the form of government in its main characteristics.
Germany
The Basic Law for the Federal Republic of Germany regulates the following characteristics of the state in Art. 20 GG:
In the words of the Constitutional Court : "Within the order of the Basic Law in any case are the State structural principles of Art 20th GG, that democracy, law and social law, the Republic, the State and the indispensable respect for human dignity substance of elementary fundamental rights in deprived of their fundamental quality from any change. "
Article 28.1 of the Basic Law also makes these principlesmandatoryfor the Länder (principle of constitutional homogeneity ); . Article 23 . Section 1 of the Basic Law links the EU - integration authorization of their presence at European level. The characteristics of the state form are subject to the eternity guarantee of Art. 79 para. 3 GG, d. that is, they cannot be modified or abolishedeven by a constitutional law .
