The THW law (THWG) came into force in 1990 as the THW Helferrechtsgesetz and forms the legal basis for the Federal Agency for Technical Relief (THW). Up to this point in time, the establishment decree of the Federal Minister of the Interior of August 25, 1953 and the Statute for Helpers of October 1, 1973 formed this very basis. A new regulation became necessary because several courts and the Federal Audit Office had serious doubts about the constitutional conformity of this regulation.

The legal mandate

The legal mandate of the THW, the legal relationship of the volunteer helpers and the costs for operations are regulated in detail . The legal mandate is set out in § 1 . Sections 2 to 6 regulate the helper's right, in detail justification of the helper relationship, rights and obligations, punishment for service violations, social security and participation. The right to help is supplemented by the THW Participation Ordinance , which the Federal Ministry of the Interior has issued on the basis of Section 4 . Section 6 contains the cost regulation, whereby a distinction is made between administrative assistance measures and others. The THW accounting ordinance regulates this , which has also been issued by the Federal Ministry of the Interior on the basis of Section 6 (3).
