history

The magazine was founded in 2002 by rundy media GmbH, Mainaschaff , as a specialist title on the subject of title protection and for the publication of title protection advertisements. Since June 2009 there has also been a separate edition for the Austrian market, the title protection journal Austria .

The German print edition appears weekly on Thursdays with a print run of 3,700 copies. Readers include book, magazine and newspaper publishers, lawyers and law firms for trademark, copyright and media law, media associations, sound carriers, radio, TV, film and software producers, TV and radio stations and title protection Agencies.

The title protection journal publishes title protection advertisements in accordance with § 5 and § 15 of the Trademark Act (MarkenG). Such an advertisement protects the titles of printed matter (e.g. books, print media), film, audio and theatrical works as well as software products and websites against the use of the same or a similar title by another party before they appear. In order to be effective, the title protection notification must be in a medium commonly used for this purpose.

Legal background

A distinctive title is already protected when the work (book, magazine, film, etc.) is published, without the need for registration or other formality. Bringing this protection forward through a title protection notification gives legal certainty with regard to the name of the work during the planning phase.

It is important that the work comes onto the market within a reasonable period of time after the title protection advertisement has been placed, usually five to six months. Otherwise the title protection expires and the title becomes free again.
