The Working Group on Arbitrary Detention (English: Working Group on Arbitrary Detention (WGAD) ) is examining a UN panel of independent human rights experts, the cases of arbitrary arrest or detention. This includes cases of imprisonment of a person by a state without a legal basis, without regard to due process or in contravention of international human rights , for example for political reasons.

The working group was set up in 1991 by a resolution of the former UN Human Rights Commission . Today it is monitored as one of the thematic special procedures by the Human Rights Council of the United Nations and is therefore a subsidiary body of the United Nations .

The UN mandate

The UN Human Rights Commission created this body on March 5, 1991 by means of a resolution in which the mandate was also defined. The UN mandate is limited to three years and is regularly extended. After the UN Human Rights Commission was replaced by the UN Human Rights Council in 2006 , the latter is now responsible and oversees. The last extension of the mandate took place on October 7, 2016.

The members of the working group are not employees of the United Nations, but are given a mandate by the UN. To this end, the UN Human Rights Council issued a code of conduct. The independent status of the elected officials is crucial for the impartial performance of their duties. The term of office of a mandate is limited to a maximum of six years.

The working group prepares thematic studies and develops guidelines for the improvement of human rights. She makes country visits and can make recommendations in an advisory capacity. Its tasks also include checking notifications and making suggestions to the states on how they can remedy any irregularities. It also carries out follow-up procedures in which it checks the implementation of the recommendations. To this end, it prepares annual reports for the attention of the UN Human Rights Council and the UN General Assembly .
