The UN Special Rapporteur on the Rights of Indigenous Peoples ( United Nations Special Rapporteur on the rights of indigenous peoples is) next to the Permanent Forum on Indigenous Issues and the Expert Mechanism on the Rights of Indigenous Peoples (EMRIP) one of the three organs United Nations , the only deals with the situation of the indigenous peoples of the world.

The office of special rapporteur was established in 2001 and was held until April 2008 by the Mexican Rodolfo Stavenhagen . On May 1, 2008, James Anaya , a Native American lawyer teaching at the University of Arizona , succeeded him. This was replaced on June 2, 2014 by Victoria Tauli-Corpuz . Tauli-Corpuz comes from the Philippines, is the director of the Philippine Tebtebba Foundation and comes from the Igorot ethnic group . Her term of office expired in 2020 and her office was transferred to Guatemalan José Francisco Calí Tzay , who was previously chairman of the UN Anti-Discrimination Committee .

The UN mandate

The UN Human Rights Commission created this position on April 24, 2001 by means of a resolution in which the mandate was also defined. This UN mandate is limited to three years and is regularly extended. After the UN Human Rights Commission was replaced by the UN Human Rights Council in 2006 , the latter is now responsible and oversees. The last extension of the mandate took place on October 6, 2016.

Act

Since his appointment, Special Rapporteur Stavenhagen has mainly focused on three areas of work:

  1. Research and research on individual topics that affect the human rights and fundamental freedoms of indigenous peoples, e.g. B. the consequences of development projects, cultural rights and the judiciary;
  2. Country visits ( fact finding mission ) on the situation of indigenous peoples, etc. a. to Guatemala and the Philippines (2002), Mexico and Chile (2003), Colombia and Canada (2004).
  3. Communicate with governments regarding human rights violations against indigenous peoples.

James Anaya did in his tenure

  1. 19 country visits carried out, with Sápmi also visiting a transnational territory for the first time.
  2. He has also turned to governments in numerous cases at the request of indigenous communities.
  3. Finally, he developed a series of thematic studies. In particular, he focused on the impact of extractive industries on the situation and rights of indigenous peoples, examined the UN Guiding Principles on Business and Human Rights and Corporate Responsibility, and examined the question of consultation and participation rights of indigenous peoples, including the concept of the free , Prior and Informed Consent (FPIC ).
