Costs (law)

Costs in the legal sense include fees and expenses . A fee (obsolete: fee ) is a charge that is levied for various official activities and the occurrence of which is ordered by a fee law. Expenses are all costs for services by third parties not involved in the procedure, which are necessary for the implementation of official or judicial procedures, e.g. B. Experts' costs, travel costs cf. Section 17 Court Fees Act .

The collection of costs in the context of the implementation of federal laws by the states as a separate matter ( Art. 83 , Art. 84 GG), by the states on behalf of the federal government (federal contract administration) ( Art. 85 GG) and by the federal government through its own authorities (Federal administration) ( Art. 86 , Art. 87 GG) is regulated in the Federal Fees Act (BGebG), which replaced the Administrative Costs Act (VwKostG) in 2013 . For the state administration, the cost laws of the states apply, e.g. B. Law on Fees and Contributions (Berlin).
