The constitutional court of the Republic of Albania ( Albanian  Gjykata Kushtetuese e Republikës së Shqipërisë ) examines the compatibility or constitutionality of sovereign acts , in particular laws , with the constitution of Albania . Its seat is in Tirana .

Legal basis

The Constitutional Court is based solely on the Constitution . She enjoys complete organic, administrative and financial independence. Law No. 8577 of February 10, 2000 is responsible for the organization and functioning of the court.

organization

The constitutional court consists of nine members who are appointed by the president and confirmed by parliament . They are elected for a term of nine years without the right to re-election. You need a high level of professional training in the field of justice and must have at least 15 years of professional experience. The composition of the constitutional court is renewed every three years. The President is also appointed by the President from among the members and must be confirmed by Parliament. The president of the court serves for three years.

Since its establishment on June 7, 1992, the Constitutional Court of the Republic of Albania has resolved the following number of cases annually:

In 2018, the members of the court, like all other judges in Albania, were reviewed by an independent commission. Three judges had resigned in advance, and four others were dismissed from office by the reviewing commission because of assets whose origin was not clear. Since the institutions that were supposed to review potential new candidates for the court were not occupied, the court was only occupied by one person in 2018 and 2019 and was incapable of office.
