The ordinance on the exemption of certain cases of transport from the provisions of the Passenger Transport Act (Exemption Ordinance) is a statutory ordinance of the Federal Ministry of Transport, Building and Urban Development . The legal basis is Section 57 (1) No. 8 Passenger Transport Act (PBefG).

The ordinance generally exempts the transport of people from the authorization requirement for certain transport cases that are not particularly significant in the context of overall transport. This traffic is also referred to as exempt traffic.

In accordance with § 1 FrStllgV:

  • Transportation by motor vehicle outside of public roads and squares, i.e. in particular apron buses at airports
  • Transport by motor vehicle in the exercise of official activities (transport of prisoners, etc.)
  • free transport in passenger cars with up to six seats
  • Traffic with which employees are transported to different jobs, as long as this traffic does not last longer than a year, e.g. B. Transports to construction sites in the construction industry
  • Transport within the framework of agriculture and forestry
  • Transport to and from school ( schoolchildren ), and also transport to and from kindergarten
  • Traffic as part of occupational therapy through hospitals or medical rehabilitation facilities
  • Carpooling
  • Transport of the handicapped to day care centers, workshops for handicapped people (WfbM) or similar.
  • Traffic between different parts of an establishment
  • Transport by the police or the armed forces (police buses, troop transports, etc.)
  • taking people into moving vehicles in the context of a move
  • taking people into hearses as part of a funeral

In order to harmonize with the European Professional Access Ordinance (Regulation (EC) No. 1071/2009), § 1 No. 4 FrStllgV reformed the paid passenger transport by bus and coach in 2012.
