The regulation on the European Aid Fund (also: FEAD Regulation or FEAD Basic Regulation) regulates the creation of a European Aid Fund for the most disadvantaged people (...) for the period from January 1, 2014 to December 31, 2020 and the objectives of the fund, the scope of the assistance, the available financial resources and their allocation per Member State, as well as the necessary rules (...) to ensure the effectiveness and efficiency of the fund (Article 1 of the FEAD Regulation).

Reasons for the FEAD regulation

With the Europe 2020 strategy , the EU member states have set themselves the goal of reducing the number of people at risk of poverty and social exclusion by at least 20 million by 2020. Since the banking, financial and economic crisis in 2007, the number of people at risk of poverty or at risk of social exclusion has increased significantly in the European Union.

Objectives of the FEAD regulation

The aim of the fund is to strengthen social cohesion; it contributes to reducing - and ultimately the worst forms - of poverty in the Union by promoting national non-financial aid programs to alleviate food shortages and serious material deprivation and / or to contribute to the social inclusion of the most disadvantaged . The aim of the fund was to alleviate the forms of extreme poverty that contribute most to social exclusion, such as homelessness, child poverty and lack of food . The European Aid Fund is also intended to promote social inclusion and, as far as possible, to eradicate poverty in the EU (see also the Europe 2020 targets).

One of the main objectives of the Europe 2020 economic program is to reduce the number of people at risk of poverty and social exclusion by at least 20 million (Article 3 (1) FEAD Regulation).

The Fund for European Aid is not intended to be a substitute for public measures taken by the Member States to combat poverty and social exclusion, and above all it is not intended to be a substitute for measures that are necessary to avert the marginalization of vulnerable and low-income groups and to increase the risk to counteract poverty and social exclusion .

Legal basis

The regulation on the European Aid Fund is based in particular on Articles 2 and 6 TEU as well as 174 and 175 para. 3 TFEU and is supplemented by delegated regulations of the European Commission .

  • Underlined in Article 2 TEU: the values ​​on which the Union is founded are respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights, including the rights of persons belonging to minorities ,
  • Article 6 TEU provides that the Union shall recognize the rights, freedoms and principles set out in the Charter of Fundamental Rights of the European Union of December 7, 2000 in the version adapted on December 12, 2007 in Strasbourg ,
  • Article 174 TFEU stipulates that the Union will continue to pursue its policy of strengthening its economic, social and territorial cohesion in order to promote the harmonious development of the Union as a whole ,
  • Article 175 TFEU specifies that the member states of the Union conduct and coordinate their economic policy in such a way that the objectives set out in Article 174 are also achieved. The definition and implementation of the Union's policies and actions and the establishment of the internal market take account of the objectives of Article 174 and contribute to their achievement .

Signing, entry into force, validity

The FEAD regulation was legally signed on March 11, 2014 in Strasbourg .

The regulation came into force on the day of its publication in the Official Journal of the European Union (March 12, 2014). It has been in force since January 1, 2014, is binding in its entirety and is directly applicable in every member state (Article 64 FEAD Regulation).
