Venue Ordinance

Many German federal states refer to the respective state-specific statutory ordinance as the Assembly Ordinance ( VStättV (O) ) , which refers to the construction and operation of so-called assembly venues. The Model Assembly Ordinance (MVStättV) drawn up by the German Conference of Building Ministers (ARGEBAU) is intended to serve as the basis for a nationwide standardization of these state regulations, but is legally binding neither for citizens nor for state governments. Due to the new MVStättVO from July 2014, open-air meeting places were moved out of the scope. In practice, guidelines , guidelines , guidelines or leaflets from the federal states are increasingly used for these species , which often have similar or higher and more detailed requirements.

Historical development

Theaters and acting companies have a long tradition. Even in antiquity, people enjoyed public performances in sometimes huge open-air theaters. However, it was not until the end of the 18th century that an awareness of the dangers and risks that can come with the public gathering of many people in a small space developed.

Even before that, there had been a number of documented accidents in theaters. First and foremost, fires that were triggered by lighting equipment with an open flame often occurred, since the buildings concerned were often equipped with highly flammable building materials.

In Germany in 1879 “Local Police Regulations on Fire Police in Theaters” were issued. In 1909, the "Police Ordinance on the structural systems, the interior furnishings and the operation of theaters, public event rooms and circus facilities" became valid as the so-called theater ordinance. Even at this point in time, this ordinance regulated both the construction and operation of “meeting places”. In addition, in 1925 the "Lichtspielverordnung" was created, which regulated the safety of film screenings .

The term

Immediately after the Second World War, DIN 18600 “Places of assembly” was drawn up, which was to be incorporated into the respective state building regulations, but was only adopted in 1969 as a sample draft. From the beginning of the 1970s, assembly regulations were introduced in the first federal states. With the exception of the city-states of Hamburg and Bremen, all federal states had submitted a state-specific ordinance on places of assembly based on the model draft by 1979. In the GDR , an independent building law (“special building regulations for assembly rooms”) developed in parallel. The attempt at a revision at the end of the 1980s was initially stranded by the German reunification . At the beginning of the 1990s, the topic was taken up again because of the need for nationwide legislation. Two areas were considered to be of priority: the draft of a model building regulation and that of a model assembly regulations. The building supervision commission of the building ministers' conference was therefore commissioned to develop the two sample designs.

Legal Status

It should be noted that such model regulations and model decrees only serve as a basis for implementation in specific national law. They therefore do not have any direct legal effect. Each federal state thus decides to what extent the state regulation follows the model. The Model Assembly Ordinance (MVStättV 2002) was drawn up on the basis of the model building regulations (MBO 1997). This was revised for the MVStättV 2005.

Current developments

The Places of Assembly Ordinance has a long tradition in Germany and reflects historically relevant phenomena of the respective time. In the more than 100-year history, the different designs bear the face of the respective epoch. At the beginning the theater was the core content of the regulation, later the cinema came into fashion and made adapted safety regulations necessary. Today, the regulation is shaped by changed framework conditions such as popular major events (e.g. festivals, concerts in stadiums ) or the professional use of show laser and stage technology . Further evidence of the changing requirements are the reduction to “stage area ” and “ stage ”, the inclusion of barriers in front of stage areas (e.g. at open-air events) or the adaptation to the newly created training branches.

Implementation of the model regulation in the German federal states

The implementation of the sample draft from 2002 (and later also the sample draft 2005) took place swiftly and one-to-one in terms of content in some federal states. Due to the federal structure of Germany, other federal states initially did not implement the model ordinance or only partially implemented it. At the same time, objections to the content of the model ordinance were raised from various sides.

In North Rhine-Westphalia, the Places of Assembly Ordinance in 2009 was repealed and combined with the provisions for other special commercial buildings in the Special Building Ordinance (SBauVO) . The "orientation framework" of North Rhine-Westphalia is increasingly used as a basis for temporary events.

The model draft from July 2014 was implemented with only a few changes in Schleswig-Holstein as the first federal state. One of the main changes is: a. the scope in §1, according to which open-air events are only included in the ordinance with grandstands that are not floating structures. Bavaria had already adopted and implemented this change in April 2013 during the consultation phase.
