Administrative Accessory

From Verwaltungsakzessorietät is used when the fulfillment of a criminal offense is subject to regulations of administrative law . Administrative accessibility plays a role, for example, in environmental offenses or in narcotics law and other offenses under secondary criminal law . In the case of administrative access , criminal liability arises from the violation of an administrative obligation (see Section 330d No. 4 StGB). A sub-case of administrative accessory is administrative act accessory , in which the fulfillment of a criminal offense depends on the existence of an administrative act . In Germany, water pollution ( Section 324 of the Criminal Code ) is an example of adversity to administrative acts . If, for example, there is a permit to introduce substances into bodies of water, the contamination of bodies of water is not unauthorized and therefore not punishable under Section 324 of the Criminal Code.

Outside of Germany, too, administrative accessoriety occurs in most countries, as it enables citizens to rely on the regulations of administrative authorities.
