Preliminary briefing of possession

from Wikipedia, the free encyclopedia

The participants of a land regrouping procedure can before the validity of the land consolidation plan to be admitted provisionally in the possession of the new land, where their limits have been transferred to the locality and there are definitive evidence of surface and value of the new land and established the ratio of compensation to the deposit.

Through the pre-construction (communal facilities are built on private areas, which only become property of the municipality when the execution order is issued ), the field division can be cut through or split up. Since the work on the land consolidation plan is time-consuming, the agricultural use of the future new land can already begin approx. 1–2 years earlier. The acceleration principle and the purpose of the land consolidation procedure are thus taken into account. The preliminary possession briefing is a general order ( administrative act ), which can also be provided with transition provisions (as in the executive order).
