An advertising refuse is someone who does not want to receive unaddressed mail . For this purpose, a clearly visible notice can be attached to the mailbox that advertising is not desired.

Situation in Germany

In Germany, this is legally based on the law against unfair competition :

"An unreasonable annoyance is to be assumed in particular ... in the case of an advertisement, although it can be seen that the recipient does not want this advertisement"

According to a final judgment by the Lüneburg Regional Court, a declaration of intent in the form of an objection to the sender of the unsolicited advertising is sufficient, as a sticker can mean that even desired advertising is no longer delivered. A lawyer had contradicted the delivery of the mail piece “ kaufaktuell ”to Deutsche Post AG. Since this did not stop the service despite the objection, an action for injunctive relief was brought , which was fully upheld in the second instance.

Addressed direct mail will also be delivered if there is a notice on the mailbox.
