Advertising waiver

from Wikipedia, the free encyclopedia

The term advertising waiver refers to a specifically Austrian regulation dealing with the rejection of direct mail . This is a voluntary self-restriction of the advertising material distributors without a legal regulation on the part of authorities and authorities. The so-called no advertising sticker is accepted by the post office and other delivery companies. To purchase an advertising waiver, a sufficiently franked letter including a sufficiently franked and fully addressed return envelope with the password “Please no advertising material” must be sent to PO Box 500 in 1230 Vienna. The operator of the post office box is a private law association of advertising material deliverers, of which the WKO advertising department claims to be in no way connected. The sticker can only be ordered in writing and by post. A maximum of two stickers will be sent per reply envelope; on the condition that the application contains the addition “Please send 2 items”. Any other, sufficiently perceptible evidence such as B. easily visible self-made stickers on letter boxes or apartment doors must be respected by the advertising material distributors. “If unaddressed advertising material continues to be delivered in spite of such a notice, you can take action against it with an infringement complaint. This action is aimed at the omission of future disruptions and must be brought to the responsible district court within 30 days. "

Waiver of advertising

In 2006/07, Österreichische Post AG launched a nationwide campaign to “forego advertising” under the slogan “Best informed. Swiss Post brings something for everyone. ” In the mailboxes with the appropriate stickers there were letters titled “To the residents” and the exact address.

With these mailings from the Infomail marketing department of the Post, the residents concerned were asked to consider the option of removing the advertising waiver sticker or allowing the Post to have it removed. For the waiver of the sticker, a discount voucher booklet worth 60 euros was even offered, as well as participation in a raffle for 50 iPods or 10 Nespresso machines. The Swiss Post justified the advertising campaign by stating that not everyone who has a non-advertising sticker or a red sign on their mailbox really doesn't want any advertising (stickers could still come from previous tenants). These campaigns were repeated in 2008 with different arguments, whereby in the course of the economic crisis the benefit of direct mail and the information it gained was pointed out.

Partial addressing and waiver of advertising

In Austria, partial addressing is offered by Swiss Post under the name “Info.Post select”. This product is described as follows on the homepage of Österreichische Post AG: “Info.Post select is a partially addressed item whose address does not contain a name, but the postal address of a specific house in which people with specific interests live.” On the admissibility of partially addressed items There are differing views on deliveries despite the non-advertising sticker. At the beginning of 2005, consumer protection was at a loss about this procedure of distributing partially addressed and unsolicited advertising, but the view is increasingly emerging that the formal statutes of unsolicited sending of partially addressed advertising would be dubious or even illegal. So far there are no findings of state jurisdiction.
