Confirmation of acceptance

from Wikipedia, the free encyclopedia

The confirmation of receipt (also: Forwarders confirmation; . English Forwarders Certificate of Receipt (FCR)) is a transport document and document accompanying the goods .

The FCR gives the freight forwarder the option of handing over the forwarder's own receipt to the sender. The FCR can be given to the sender immediately after the freight forwarder has taken over the goods. Only one original is issued. The FCR is always issued to a named recipient and is therefore a name paper .

By issuing the FCR, the carrier confirms

  • the receipt of the transported goods;
  • to have accepted the shipment with the irrevocable transport order to send it to the recipient named in the document;
  • deliver the goods to the named recipient.

Legal character

For the seller, the FCR is therefore a bearer paper with which he proves that he has fulfilled his delivery obligation within the agreed date. This order can only be canceled if the original of the FCR is returned to the freight forwarder who issued the document, i.e. only as long as the sender has not yet forwarded the original and / or the issuing freight forwarder still has the right to dispose of the designated shipment has ( limited right of disposal ). The FCR is not negotiable. The delivery of the goods to the recipient does not depend on the submission of this document. The FCR is therefore not a legitimation paper . The FCR does not represent ownership of the goods and therefore has no traditional function .

liability

The freight forwarder is only liable for the careful selection of carriers / carriers / forwarders, but not for their errors, in accordance with the General German Forwarding Conditions (ADSp).

The (green) FIATA form is often used for FCRs.
