The drug prescribing regulation regulated in Germany which drugs from pharmacies on presentation of a by a doctor , veterinarian or dentist issued recipe is to be presented. It also specifies the information required on the prescription. For drugs subject to the Narcotics Act, the Narcotics Prescription Ordinance applies.
A prescription is not subject to any form requirements, so it can also be handwritten on a piece of paper. However , it must contain the information prescribed in Section 2 (see recipe).
There are two exceptions for the dispensing of prescription drugs ( § 4 AMVV):
- If the use of a prescription drug does not allow postponement, the prescribing person can inform the pharmacist in a suitable manner, for example by telephone, about the prescription and its contents; the prescription must be submitted as soon as possible.
- Even for the personal use of a prescribing person, the prescription does not require a written form if the person in a pharmacy is legitimized as a doctor, dentist or veterinarian by his doctor's card and identity card or is already personally known as such.
With the ordinance on the reorganization of the prescription requirement for pharmaceuticals of December 21, 2005, these two exceptions had been deleted without replacement, which, however, turned out to be problematic in practical implementation in everyday pharmacies. Six months later, the ordinance was improved and the old regulations came into force again with effect from July 1, 2006.
The repeated dispensing of a prescription drug on the same prescription in excess of the prescribed amount is prohibited.
