Waste disposal facility

A waste disposal facility within the meaning of the German Recycling and Waste Act is a facility that requires a permit with technical facilities for handling, intermediate storage, sorting, mechanical, biological, thermal or chemical treatment of waste and other materials or the permanent disposal of non-treatable residues .

A distinction is made between the following procedures:

Plant types

According to the classification according to the fourth ordinance for the implementation of the Federal Immission Control Act (4th BImSchV ), a number of systems are listed under point 8 (recovery and disposal of waste and other materials) for their construction and changes in accordance with Section 10 of the Federal Immission Control Act a formal approval procedure (so-called " column 1 systems ") with public participation is required.

A distinction is made between the following systems:

  • 8.1

a) Plants for the disposal or recycling of solid, liquid or gaseous waste contained in containers or landfill gas with combustible components by thermal processes, in particular degassing , plasma processes, pyrolysis, gasification, incineration or a combination of these processes

b) Combustion engine systems for the use of waste oil or landfill gas with a thermal input of 1 megawatt or more

Systems for generating electricity, steam, hot water, process heat or heated exhaust gas through the use of

a) Painted, varnished or coated wood as well as any residues arising therefrom, provided that no wood preservatives are applied or contained as a result of a treatment or coatings do not contain organohalogen compounds or heavy metals , with a thermal output of 50 megawatts or more, or

b) Plywood , chipboard , fibreboard or otherwise glued wood as well as any residues arising from it, as long as no wood preservatives are applied or contained as a result of a treatment or coatings contain no halogenated organic compounds or heavy metals, with a thermal output of 50 megawatts or more in a combustion facility (such as a power plant, Combined heat and power plant, heating plant, other combustion system), including the associated steam boiler

Plants for the biological treatment of a) hazardous waste to which the provisions of the Recycling and Waste Management Act apply, with a throughput of 10 tonnes of waste or more per day or b) non-hazardous waste to which the provisions of the Recycling and Waste Management Act apply with a throughput of 50 tonnes of waste or more per day, with the exception of systems that are covered by number 8.5 or 8.7

  • 8.7

Plants for the treatment of contaminated soil, to which the regulations of the Recycling and Waste Act apply, by biological processes, degassing, stripping or washing with the use of 10 tons of contaminated soil or more per day

  • 8.8

Installations for chemical treatment, in particular for chemical emulsion splitting , precipitation , flocculation , neutralization or oxidation of

a) hazardous waste to which the provisions of the Recycling and Waste Act apply,

b) or non-hazardous waste to which the provisions of the Recycling and Waste Management Act apply, with a throughput of 50 tons of input materials or more per day

a) Systems for crushing scrap by means of rotor mills with a rated power of the rotor drive of 500 kilowatts or more

b) Facilities for the temporary storage of ferrous or non-ferrous scrap, including wrecked cars, with a total storage area of ​​15,000 square meters or more or a total storage capacity of 1,500 tonnes of ferrous or non-ferrous scrap or more, with the exception of temporary storage until collection on the site where the waste is generated and Installations that are covered by number 8.13

Plants for physico-chemical treatment, in particular for distilling , calcining , drying or evaporation of a) hazardous waste, to which the provisions of the Recycling and Waste Act apply, with a throughput of 10 tons of input materials or more per day or

b) non-hazardous waste to which the provisions of the Recycling and Waste Management Act apply, with a throughput of 50 tonnes of input materials or more per day

Systems for the treatment of hazardous waste , to which the provisions of the Recycling and Waste Act apply,

aa) by blending or mixing as well as by conditioning ,

bb) for the main use as fuel or energy generation by other means,

cc) for the purpose of oil refining or other ways of recycling oil,

dd) for the purpose of regenerating bases or acids,

ee) for the purpose of recovery or regeneration of organic solvents or

ff) for the purpose of recovering components that serve to combat contamination

with a throughput of 10 tons of input materials or more per day, with the exception of systems that are covered by numbers 8.1 and 8.8

Facilities for the temporary storage of hazardous waste , to which the provisions of the Recycling and Waste Management Act apply, with a storage capacity of 10 tons or more per day or a total storage capacity of 150 tons or more, with the exception of temporary storage until collection on the premises of the Creation of the waste and facilities that are covered by number 8.14

Systems for the temporary storage of hazardous sludge , to which the provisions of the Recycling and Waste Management Act apply, with a storage capacity of 10 tons or more per day or a total storage capacity of 150 tons or more

a) Facilities for the storage of hazardous waste to which the provisions of the Recycling and Waste Management Act apply and insofar as waste is stored in these facilities for a period of more than one year before it is disposed of or recycled

b) Facilities for storing non- hazardous waste , to which the provisions of the Recycling and Waste Management Act apply and insofar as waste is stored in these facilities for a period of more than one year before they are disposed of or recycled, with a capacity of 10 tons or more per day or a total storage capacity of 150 tons or more

  • 8.15

Facilities for handling hazardous waste , to which the provisions of the Recycling and Waste Management Act apply, with a capacity of 10 tonnes or more per day, with the exception of facilities for handling excavated earth or rock that occurs during the extraction or processing of mineral resources.

Plants with lower incineration or throughput capacities fall under column 2 of the 4th BImSchV and are not in the formal, i.e. H. processed public approval procedures in accordance with Section 10 of the Federal Immission Control Act , d. H. that only a simplified approval procedure - without public participation - has to be carried out for the construction or changes to these waste disposal systems.
