File number (Liechtenstein)

The file number is part of the identification of files (documents) used by the Liechtenstein courts and authorities.

Explanation

All judicial documents (for example: submissions, protocols, originals, delivery cards, etc.), which concern the same thing, are to be united under a common name, the file number (Art 20 and 22 GeoLG), to the act of this thing.

For historical reasons, the structure of files and file numbers in Liechtenstein follows the structure of the same in Austria .

Files

According to Art. 21 Para. 1 GeoLG, all documents received by the court or authorities are to be taken to the files in the order in which they were received, given sequential serial numbers and page numbers, and combined under one and the same common name. (In practice, a colored cardboard folder is often used as an envelope). In the case of court files, the enclosures must also be collected in a separate document folder. This is to be attached to the act (Art. 20 Para. 2 GeoLG).

Within an act, the individual documents are lined up in chronological order. The most recent document is on top.

If an already existing file is passed on or assigned to another department of the court registry, the file number on the file cover or envelope must be crossed out and the file continued under the changed file number. The new file number must be noted in the first register (Art 22 para. 3 GeoLG). Only the naming of the file (file bundle) with a file number (see below) results in the file .

File number

The file must be identified on the outside of the file cover or on the file envelope with the file number and the name of the case. The file number in accordance with Section 22 (2) GeoLG consists of an abbreviated item designation (generic code), a consecutive number (file number) and a brief statement of the year of occurrence. The item designation (generic symbol) is preceded by the number assigned to the judicial department.

Number of business department

The abbreviation of the business departments at the Liechtenstein courts is made up of a maximum two-digit number (letters are only used in exceptional cases).

Item designation - register code

The register number is the part of the file number that refers to a specific file register . The item designation (generic symbol) is used to find the file in a specific register.

In the Liechtenstein courts, according to Art. 22, Paragraph 2, Numbers 1 to 3 GeoLG and according to the business group and distribution overview of the Regional Court, the following register symbols (item designation or generic symbols) are used:

Dg	Disciplinary matters of the first instance regarding non-judicial staff.

E.	Payment orders and executions of all kinds.
Eg	Cases under the marriage law, with the exception of declarations of marital status.
It	Single judge in crime and misdemeanor cases according to §§ 312 ff StPO.
Eu	Single judge in cases of offense and violation according to §§ 317 ff StPO.
Ex	Payment orders, legal messengers, executions of all kinds, disclosure oath according to Art 14 para. 2 lit. b RpflG.
Gb	Complaints in land registry matters.
Gg	Requests for corrections, discounts, deferrals and declarations of irrecoverability in court fee matters.
Ed	Non-contentious matters according to the PGR.
Born	Chairman of the juvenile court.
Jv	General administration of justice, supervision of the administrative manager / regional court office / central services department, supervision of IT project management, external representation of the court, library. Information officer according to the Information Act. Supervision of the placement offices.
K	Judicial dismissals as long as they are not disputed.
Kg	Chairman of the criminal court. Assessor in the criminal court.
Ko	Bankruptcy cases.
Kü	Terminations and orders according to § 567 ZPO.
No	Execution-related business items that are not to be classified under any of the abbreviated designation above and that are not to be taken as part of a pending execution case. Provisional orders in accordance with Art 272 EO.
Nk	All other business items that are not to be taken into the act of a pending bankruptcy or estate contract matter.
Np	Curators, trustee court approvals and other business items that are not to be taken into a Pg matter and that are reserved for the jurisdiction of the judge in accordance with Art. 17 para. 2 RPflG. Declarations of disappearance, adoptions, shortening and extending the minority, declarations of marriage, parentage procedures. Curators, trustee court approvals and other business items that are not to be taken into a Pg matter in accordance with Art. 17 Paragraph 1 RPflG (handling by Rechtspfleger).
Ns	Items of criminal law that cannot be classified under any of the abbreviated designation above and that are not to be included in a pending criminal case (e.g. conversion of customs fines, pardon requests for criminal records, permits under Art 34a Paragraph 4 PolG).
Nv	Estate contract matters.
Nz	Civil law business items that are not to be classified under any of the abbreviated designation above and that are not to be taken as part of a pending civil case. Legal messengers, public notarizations, declarations of nullity, judicial deposits in accordance with § 1425 ABGB, other non-contentious matters, agency regulations.
Or	Complaints in public register matters.
P	Guardianship matters, incapacitation and legal changes.
Pg	Custody matters in accordance with Art. 17 Para. 1 RPflG (maintenance determination for minors). Guardianship, deputy, advisory board, guardianship that is reserved for judges according to Art. 17 para. 2 RPflG.
Pr	Notices of bias and exclusion according to Art 56 to 61 GOG.
R.	Retention descriptions.
Ra	Information on Liechtenstein law in accordance with European conventions relating to information on foreign law and information in accordance with Section 70 SchlT on the PGR (requests for information from foreign authorities on FL law).
Rö	Legal opening matters.
Rs	Legal assistance in criminal matters, extradition matters, judicial transactions in accordance with the Savings Tax Act.

Years

The year is specified in the file number by using the four digits of the year of occurrence (example: 2005 for the year 2005).

File number

For the files, consecutive numbers beginning annually with one are entered in a register (Art. 18 Paragraph 7 and Art 21 Paragraph 1 GeoLG).

The file number is an Arabic number, separated by the " . "Is differentiated from the year (earlier as in Austria with" / "as a separator used).

Serial number

The individual business items are to be taken to the files in the order in which they were received and to be provided with consecutive serial numbers and page numbers (Art. 21 Paragraph 1 GeoLG).

The records are given consecutive serial numbers that start with 1 in every legal case and continue regardless of the end of the year.

Every piece of business that arises or arrives at the authority receives a serial number.

Files

More extensive files must be structured (for example, summarized in volumes of approx. 500 pages each). The file number is not changed by creating file volumes. A number (for example I to IV) is consecutively assigned to the file volume, which is placed after the file number.
