Andreas Erler (* 1961 in Bischofswerda ) is a German politician ( CDU ). During the political change in 1990 he was elected mayor of Bischofswerda, as a result of the city's appointment as a major district town in 1998, he became mayor . He held this office until July 31, 2015, but did not run again in the mayoral elections in June 2015. Holm Große was elected as his successor.

Shortly before the mayor election in 2008, Andreas Erler summarized important goals of his work in a newspaper interview. He has long been committed to building the bypass , commercial and industrial settlements in Bischofswerda and the modernization of schools and administration. Due to his many years of experience as an office holder, he has excellent contacts to politics, administration and business. In December 2011, Erler named the connection of Bischofswerda to the Dresden S-Bahn network as the next destination .

The importance of the Bischofswerda bypass, for the construction of which Erler also made a significant contribution for years, was emphasized on the day of its opening in mid-December 2011, among others, by Saxony's Transport Minister Sven Morlok . He said that the residents in Bischofswerda would now be relieved of truck traffic and that the economy would get a fast connection to the A4. Many Bischofswerda residents consider the bypass to be a stroke of luck, but some retailers in Bischofswerda expressed concern that customers could be lost with the opening of the bypass.

Andreas Erler has been a board member of the lobby organization Society for the Promotion of Environmentally Friendly Road and Transport Planning (GSV), which supports the construction of over 100 road construction projects across Germany , since 1998 . For example, the construction of bypasses is intended to relieve residents of busy streets. According to its own statements, the GSV would like to give the often silent majority a vote. Critics point out that the GSV would have the work of their state representatives financed by the road construction industry. The GSV itself initiated the establishment of citizens' initiatives for road construction. Andreas Erler himself initiated the founding of the citizens' initiative to build the Bischofswerda bypass in October 2002.

Legal disputes over mayoral elections

For the first time, in December 2011, a mayoral election of a Saxon city was canceled for the second time: The Bischofswerda mayor election in June 2008, which he narrowly won with 50.5 percent, was declared invalid by the Dresden Administrative Court in September 2009, after Andreas Erler a few days had declared before the election that he would like to donate one euro to clubs in the city for each vote cast. The Dresden Administrative Court saw this as an inadmissible influence on voters.

In February 2010 the election was repeated. At that time, 52 percent of the people of Bischofswerda voted for the incumbent mayor, 48 percent for his opponent Jens Krauße (SPD). In March 2010, the Bischofswerda lawyer Jürgen Neumann initially lodged an objection to the district office against the recognition of this election. This was rejected and Neumann first moved to the administrative court and later lodged an appeal with the Saxon Higher Administrative Court . In a leaflet that was distributed a few days before the election re-election and in which allegations were made about the sexual orientation of the opposing candidate, the judges of the Saxon Higher Administrative Court found that the voters were inadmissible. According to the Sächsische Zeitung, the leaflet was distributed without the knowledge of Andreas Erler. Even before the election, 27 percent of the test voters stated in a survey that the leaflet had influenced them in their decision.

On January 19, 2012 it became known that Andreas Erler would not accept the judgment of the Saxon Higher Administrative Court and that the dispute over the mayoral elections would become a case for the Federal Administrative Court . The district office as the local authority did not want to object itself. On July 5, 2012, the Federal Administrative Court overturned the judgment of the Higher Administrative Court and referred the legal dispute back to the OVG Bautzen (Az. 8 B 24.12). As a result, the Saxon Higher Administrative Court recognized the election of the previous incumbent mayor of Bischofswerda as valid on January 15, 2013 (Az. 4 A 462/12).
