The Residence Ordinance is a statutory ordinance applicable in Germany , which mainly contains supplementary provisions for the implementation of the Residence Act . It was enacted as Article 1 of the Ordinance Implementing the Immigration Act.

Subject matter

The ordinance contains regulations on the following subjects:

  • Passport requirement for foreigners; Admission of foreign and introduction of German passport substitute papers (§§ 1 to 14);
  • Exemptions from the requirement of a residence permit , in particular a visa , and restrictions on exemptions for foreigners who want to work in the federal territory (Sections 15 to 30), including special regulations for flight personnel ( Section 23 ), seafarers ( Section 24 ) and inland waterway transport ( Section 25 );
  • Requirement for the approval of the immigration authorities or the highest state authority in the visa procedure (Sections 31 to 38);
  • Recognition of research institutions for the special admission procedure according to the EU Researcher Guideline and conclusion of admission agreements with researchers from third countries (Sections 38a to 38f);
  • Possibilities of obtaining the residence permit in the federal territory for longer stays without a preceding visa procedure (§§ 39 to 41);
  • Relocation of the residence of refugees within the EU, provided they fall under a certain EU directive (§§ 42, 43);
  • Collection, reduction and exemption of fees for official acts in the area of immigration law (Sections 44 to 54);
  • Regulatory regulations, especially on identification obligations (Sections 55 to 57a);
  • Templates for residence permits and forms for passport replacement papers (Sections 58 to 61);
  • Files of the immigration authorities and data transfers to immigration authorities (§§ 62 to 76a) and
  • Administrative offenses (Sections 77, 78).
