The BGB Information Obligation Ordinance (BGB-InfoV) originally regulated the information obligations that an entrepreneur must observe when concluding distance sales contracts , part-time housing rights contracts , contracts in electronic business transactions or travel contracts with a consumer . Furthermore, the information obligations of credit institutions have been specified. The BGB-InfoV thus supplemented numerous consumer law provisions of the German BGB . In 2011 all paragraphs of the BGB-InfoV were repealed except for Sections 9-14 BGB-InfoVO, which dealt with the information and proof obligations of tour operators. In place of the omitted regulations, Artt. 246 f. EGBGB , to which the relevant provisions of the BGB have since referred.

Regulation content from 2011

For travel contracts, the BGB Information Obligation Ordinance specified the old regulations on travel contract law in Sections 651a to 651m BGB old version, which were valid until July 31, 2018.It essentially regulates the content of the information on the travel brochure and the General Travel Conditions (ARB). The information in the travel brochure (or comparable information from the tour operator) was binding in accordance with Section 4 (2) sentence 1 BGB-InfoV. The tour operator was u. a. obliged to provide extensive information on visa, passport and health formalities. In addition, the BGB-InfoV regulated the template for the travel security certificate, which is binding according to § 651k Paragraph 5 BGB old version. The regulation also regulated details of the manner in which this information had to be communicated to the consumer.

Repeal of the BGB-InfoVO as part of the reorganization of the travel contract law 2018

The BGB-Info-VO was repealed with the entry into force of the new travel contract law in the BGB (§§ 651a to 651y BGB) on July 1, 2018. The regulations corresponding to the repealed regulations and adapted to the new package travel law can now be found in Art. 250 EGBGB : "Information requirements for package travel contracts".
