Baby M (born March 27, 1986 ) was the pseudonym of a child in an American custody suit. The process was conducted between the surrogate mother who was hired to carry the child and the child's biological father.

Mary Beth Whitehead, the surrogate mother, had been artificially inseminated with William Stern's semen . Contrary to popular belief (and also contrary to what was stated in the surrogate motherhood contract) Stern's wife Elisabeth was not sterile, but there was a possibility that she had multiple sclerosis and could be temporarily paralyzed by the pregnancy .

On March 27, 1986, Mary Beth Whitehead gave birth to a daughter, whom she named Sara Elizabeth Whitehead , and refused to hand her over to the Sterns. A New Jersey court in 1987 gave the Sterns custody of Melissa (as they called the child). This judgment was changed on February 2, 1988 by the New Jersey Supreme Court: William Stern was granted custody and Mary Beth Whitehead was granted visiting rights.
