Bardo Fassbender

Bardo Fassbender (* 1963 in Königswinter ) is a German legal scholar. He is a full professor for international law, European law and public law at the University of St. Gallen . His main research areas include the general international law , the law of the United Nations , comparative constitutional law and constitutional theory and constitutional and international legal history.

Life

Bardo Fassbender studied law, history and political science at the University of Bonn and the Yale Law School . He received his Master of Laws (LL.M.) from Yale Law School and was at the Humboldt University of Berlin Dr. iur. PhD. At Humboldt University he qualified as well and got the teaching certificate for the subjects Public, International and European law and constitutional history.

In his dissertation entitled UN Security Council Reform and the Right of Veto: A Constitutional Perspective , Fassbender dealt with the functions and competencies of the United Nations Security Council . For his work he was awarded the doctoral prize of the Law Faculty of the Humboldt University in Berlin. He wrote his habilitation thesis in 2004 on the subject of the open state. Studies on foreign violence and the subjectivity of federal states in Europe.

Fassbender was Ford Foundation Senior Fellow in Public International Law at Yale University, Jean Monnet Fellow at the European University Institute in Florence and representative of the Chair of Public Law, International Law and European Law at the Ludwig Maximilians University in Munich. In 2008 he was appointed full professor for international law, with special emphasis on international human rights protection, at the University of the Federal Armed Forces in Munich . He did not accept a call to the chair for public law, in particular international law, at the University of Bonn in 2009. He has been a full professor at the University of St. Gallen since 2013 .

In addition to his teaching and research activities, Fassbender is also active as a consultant. For example, he advised the Legal Counsel and Under-Secretary-General of the United Nations on the issue of legal protection against individual sanctions by the UN Security Council.

Fassbender has been critical of the European Union's actions in the conflict over the Spanish region of Catalonia , which is striving for independence . He particularly criticized the lack of self-understanding of the European Union as a “citizens' union”. Instead of advocating for the interests of its Union citizens , the European Union is still stuck in the thinking of an international organization in the classic sense, which has no direct connection between citizens and organization.
