Officials at the postal successor companies
Civil servants at the post office successor companies are employed by the stock corporations that emerged from the Deutsche Bundespost after the Post Reform II .
Since the conversion of the Deutsche Bundespost into the stock corporations Deutsche Telekom AG , Deutsche Post AG and Deutsche Postbank AG in 1995, the stock corporations are no longer allowed to employ civil servants .
Special legal regulations
The officials of the postal successor companies are still federal officials ( Section 2 (2) of the Post Personnel Law Act (PostPersRG)). The Federal Civil Service Act and other federal laws continue to apply to them. However, the law on personnel law for employees of the former Deutsche Bundespost (PostPersRG) created special regulations. A number of regulations regulate z. B. Special features of special payments and working hours.
Article 143b of the Basic Law
With the Postreform II, the special fund Deutsche Bundespost was converted into a private company. The stock corporations are obliged to continue to employ the civil servants who are already working for the Deutsche Bundespost while maintaining their legal status. The companies exercise employer powers ( Art. 143b Basic Law (GG)).
Responsibilities of the Federal Ministry of Finance
The legal responsibilities for civil servants employed by the stock corporations lie with the Federal Ministry of Finance ( Section 3 , Paragraph 9 PostPerRG).
Early retirement arrangements
With the law for the improvement of the personnel structure in the federal railway assets and in the post office successor (BEDBPStruktG) regulations for other use of the civil servants were created. Civil servants of the postal successor companies can be retired on request if they have reached the age of 55 and business or economic interests do not conflict. The joint-stock companies bear the additional financial burdens of the post office employee's pension fund based at the Federal Agency for Post and Telecommunications Deutsche Bundespost (BAnstPT), which result from the early start of retirement. This option is currently limited to December 31, 2020 ( Section 4 BEDBPStruktG).
