Disabled transport service
A service for the disabled is a social service to promote the participation of disabled people in community and cultural life ( Section 54 of Book XII of the Social Code , Section 78, Paragraph 1, Clause 2 and Section 113, Paragraph 2, No. 7 of Book IX of the Social Code ).
Legal and factual structure
The service for the disabled is used for leisure activities such as maintaining personal contacts, attending events or shopping trips and is limited to a certain annual amount.
In particular, severely disabled people are entitled to the benefits, and they cannot be expected to use public transport due to their disability . The prerequisite for this is usually the entry of the mark aG (exceptional walking disability), H (helpless) or B (accompaniment required) in the severely disabled ID card .
Priority is given to the use of vehicles from a facility for participation in community life such as a workshop for disabled people , transport services from old people's and nursing homes or the use of one's own vehicle that is handicapped-accessible in accordance with the Motor Vehicle Aid Ordinance .
If the disability is the result of an accident at work, vaccination damage, culpable behavior by third parties or a war event, the responsible service providers are based on special laws such as Section 40 SGB VII , the Federal Supply Act (BVG) or the Soldiers Supply Act (SVG). Ambulance transport is a service provided by statutory health insurance ( Section 60 SGB V ). On a subsidiary basis and when in need , the handicapped transport service is a social assistance service .
The driving service is provided in a so-called triangular relationship under social law . After the responsible service provider has issued a notification of approval, the transport service provider must provide evidence of the services provided to the authorized person and submit the proof of travel for billing.
For the disabled transport service special are disabled transport vehicles used.
