Bernd Volckart

Bernd Volckart (born March 27, 1933 ; † September 2, 2006 ) German judge and criminal scientist.

After working at the Ministry of Justice of the State of Lower Saxony , Bernd Volckart was appointed to the Higher Regional Court of Celle , where he was most recently the chairman of a criminal senate. His special focus was on the penal system and the penal system. As a rapporteur for his Senate, he has influenced the case law in these areas far beyond Lower Saxony. A number of successful submission orders to the Federal Constitutional Court have resulted in whole parts of the right to measure (§ 67, 67d StGB) being declared unconstitutional. His influence on practice was reinforced by his significant involvement in comments on the Penal Code , the Code of Criminal Procedure and the FEVG .

Scientific work

In addition to his judicial work, Bernd Volckart worked intensively on an academic basis. In doing so, he was interested not least in questions that are neglected at universities. He published standard works on the law on the execution of measures , on the law on the execution of sentences , but also a scientifically-based study on questions of crime prognosis . Bernd Volckart can also be seen as a champion of a rational criminal policy based on the Enlightenment . For many years he also passed on his findings to students as a lecturer in the legal department of the University of Hanover. He was co-editor of the magazine "Recht und Psychiatrie".
