Vocational training allowance

The vocational training allowance (BAB for short) is a job promotion measure of the German Federal Employment Agency . This service is regulated in Sections 56 ff. Third Book of the Social Code (SGB III) (until March 31, 2012: Sections 60 SGB III old version).

Performance requirements

Apprentices are entitled to vocational training allowance if the vocational training is eligible, they belong to the group of people eligible and cannot make their living themselves. ( § 56 SGB ​​III)

Eligible vocational training

In principle, only state-recognized in-company or external vocational training is eligible for funding. School-based vocational training is not eligible. ( § 57 Abs. 1 SGB III) In the case of disabled people, unrecognized vocational training can also be funded, provided that it is defined in accordance with § 66 BBiG or § 42m HwO. ( Section 116 (2) SGB III)

As a rule, only the first vocational training is eligible for funding; A second vocational training can be funded if vocational integration cannot otherwise be achieved and this goal can be expected to be achieved through the second vocational training. This makes a forecast decision by the administration necessary at the factual level. The promotion of a second training - unlike that of the initial training - is at the discretion of the Federal Employment Agency, i. H. Even if the forecast decision is positive, this does not necessarily mean that there is a right to funding for the second training. If the training is broken off, renewed vocational training can be funded if there was an important reason for breaking off the training. ( Section 57 SGB ​​III) For disabled people, easier conditions apply to the duration of training and a possible renewed vocational training. ( § 116 Abs. 4 SGB III)

If some of the vocational training takes place abroad, this section is also eligible, provided it does not exceed one year. Vocational training that takes place entirely in neighboring countries or in countries of the European Union are eligible if it is certified that this vocational training is equivalent to German vocational training and that it is particularly useful for achieving employability. ( § 58 SGB ​​III)

Eligible group of people

Germans within the meaning of the Basic Law are generally included in the eligible group of people. In addition, the following foreigners are eligible for funding according to Section 59 SGB ​​III:

  • Union citizens and EEA citizens with a right of permanent residence and foreigners from third countries, a settlement permit or a permit for permanent residence in the EU have
  • Family members of EU or EEA citizens who are entitled to free movement or who are only not because they are older than 21 years and are not receiving maintenance
  • Union citizens and EEA citizens who were employed in Germany prior to vocational training, if the content of the employment is related to vocational training
  • Foreigners who have been recognized as refugees outside of Germany , who have their habitual residence in Germany and who have a non-temporary right of residence
  • homeless foreigners
  • Foreigners with a Duldung , who have their permanent residence in Germany, if they have been lawfully, permitted or tolerated in the federal territory for at least 15 months without interruption
  • Foreign nationals, if either they themselves or at least one of their parents was employed for a certain minimum period before the start of the vocational training. If the trainee lives in a relative's household, the parent can take the place of the parent under additional conditions. In accordance with Section 60 of Book III of the Social Code, training grants are generally only paid if the applicant does not live with their parents and cannot live there because the trip to and from their parents' home to the workplace would take more than two hours (by public transport) . Exceptions apply to:

  • Apprentices who are older than 18 years, are married or have at least one child and move into their own apartment
  • Apprentices who cannot be referred to their parents' home for serious social reasons
  • disabled people ( Section 116 (3) SGB III)

Needs for subsistence

The basic requirement is an amount of 372 euros, plus 166 euros for the rental costs. If the rent is demonstrably higher than 149 euros, the amount increases by up to 84 euros. ( Section 61 (1) SGB III) For disabled people who live in their parents' household, the basic requirement is 316 euros; it increases to 397 euros if the disabled person is married or over 21 years old. ( Section 116 (3) SGB III) Special regulations apply to trainees who are accommodated with the trainer with full board and to trainees who are accommodated in a dormitory or boarding school.

The commuting costs between accommodation, training center and vocational school are taken as the basis for travel costs. The maximum amount is 476 euros. ( Section 63 (3) SGB III) If you need to stay away from home, a monthly family trip home is also financed. The BahnCard will also be reimbursed as soon as the costs for family trips home are lower. If a used BahnCard is not reimbursed, the normal price and not the reduced fare will be reimbursed. ( Section 63 (1) SGB III) If the training takes place abroad, in contrast to training in Europe, only a six-month family trip home is financed, while training outside Europe only finances an annual family trip home. ( § 63 Abs. 2 SGB III)

In addition, according to Section 64 of the Third Book of the Social Code, a flat rate for work clothing of 13 euros is taken into account. For trainees with children, additional care costs of 130 euros per child are recognized. Other costs can be recognized if they are unavoidable due to the vocational training and the vocational training would otherwise be jeopardized if the trainee or his or her legal guardian have to bear the costs.

Income allowance

In this order, the income of the trainee, the income of the spouse or partner and, finally, the income of the parents are to be taken into account. Income offsetting generally follows the BAföG regulations . If an external accommodation is necessary, there are additional allowances of 58 euros on the training allowance and 567 euros on the parents' income. In order to prevent performance abuse, a fictitious income in the amount of the collectively agreed or customary training remuneration is used as a basis for vocational training in the company of the parents or the spouse. If there is no entitlement to maintenance (e.g. if you have already completed vocational training), the parents' income is not taken into account. ( Section 67 SGB ​​III)

If the parents refuse to pay maintenance or to provide information about their income situation, the employment agency can provisionally pay out vocational training allowance without taking into account the parents' income after the parents have been heard. The maintenance claim is then transferred to the employment agency. ( § 68 SGB ​​III)

Approval period

The approval period for vocational training allowance is 18 months. ( § 69 SGB ​​III) After these 18 months the application must be submitted again. The application can be submitted to the responsible employment agency. If you already have a customer number at the employment agency, you can request the application by phone. Payment is made from the beginning of the training or from the beginning of the month in which the application was submitted.

There is a minimum limit of 10 euros for vocational training allowance benefits. ( § 71 SGB ​​III)

Vocational training allowance for a vocational training measure

Vocational training allowance can also be paid for participation in a vocational training measure according to § 51 SGB ​​III. ( § 56 Abs. 2 SGB III)

If the person lives with their parents, the need is 231 euros. If the person is housed away from home, the requirement is 391 euros. If the rent is demonstrably higher than 58 euros, the amount increases by up to 74 euros. ( § 62 SGB ​​III) In principle, income is not credited. ( Section 67 (4) SGB III) If an unemployed person were entitled to unemployment benefits and if they took part in a vocational training course, they would receive vocational training allowance in the amount of the unemployment benefit. If a participant has no other health insurance, the contributions for voluntary health insurance are taken into account as a requirement. ( § 64 Abs. 2 SGB III)
