The Guarding Ordinance (long title: "Ordinance on the Guarding Trade "; abbreviation: BewachV) is an ordinance that was issued by the Federal Minister of Economics of the Federal Republic of Germany with the consent of the Bundesrat based on the authorization of Section 34a, Paragraph 2 of the Industrial Code . The regulation was revised on May 3, 2019 ( Federal Law Gazette I p. 692 ).

The Guarding Ordinance explains in more detail what guarding is, where guarding can take place, who is allowed to guard and which requirements must be met.

In most federal states, it is the responsibility of the competent regulatory authorities to check compliance with the Guarding Ordinance , which also punish violations.

The Guarding Ordinance contains in particular more detailed provisions on the training certificates required under Section 34a of the Trade Regulations. So for the proficiency test, which is a prerequisite for the permission of a security trade ( § 34a Abs. 1 Satz 3 Nr. 3 GewO with § 9 BewachV), and for the instruction ( § 34a Abs.1a GewO with § 4 BewachV) of the tradesman employees entrusted with guarding tasks, i.e. the security guards . The chambers of industry and commerce are responsible ( § 5 and § 10 BewachV). It also regulates the guard register , uniforms, ID cards and other identifiers as well as the handling of weapons, the documentation requirements and the liability insurance required under commercial law.
