CEF measure

As a CEF measure ( continuous ecological functionality measures , translation measures for the permanent ecological function ) in the area of intervention regulation measures of species protection are understood. The legal basis in Germany results from Section 44 Paragraph 5 i. V. m. Section 15 of the Federal Nature Conservation Act (intervention regulation). The decisive criterion is that it is carried out in a direct functional relationship before an intervention. Ecological and functional continuity should be guaranteed without any time gaps. It is an early compensatory measure . Success is checked through accompanying monitoring .

CEF measures are aimed directly at the affected population of protected species. They should preserve the quality and quantity of the habitat for the affected population . The measure should have a direct spatial reference to the affected habitat and create adjacent new habitats that have a direct functional relationship with the original habitat.

A ruined building is to be demolished. It is the habitat for legally protected bats , for which the loss of their habitat would represent a significant encroachment. According to legal requirements, suitable living spaces must be created before the building is demolished as part of a CEF measure: For the loss of external crevice quarters (e.g. behind shutters), nest boxes (in this case flat boxes ) can be hung in suitable places (e.g. on other buildings in the vicinity). It must be ensured that the CEF measure reproduces the situation of the respective habitat that is being lost as well as possible so that it can also be effective as a compensation for this habitat and for the species concerned. Bat boxes are usually not a suitable compensation for the loss of underground winter quarters, such as B. basements of building ruins. The effectiveness of CEF measures must be guaranteed before the loss occurs and confirmed through success monitoring in order to be improved if necessary.
