Edda (pug)

Edda ( renamed Wilma after sale ) is a pug that was seized by the city of Ahlen at the end of 2018 and sold on eBay classifieds . A legal dispute ensued because the dog was not as "very healthy" as stated. The animal had to undergo expensive operations and will require further medical treatment in the future.

The case also raised other questions: Can a dog be seized? Can a seized dog be sold via a private account on the Internet? In addition, the case touches on problematic areas such as online pet trade or torture breeding .

The ongoing procedure is still ongoing.

Edda was seized by foreclosure at the end of 2018 because the affected family was in arrears with the city of Ahlen with the dog tax payments. A city employee offered the dog on his private Ebay account for 750 euros and praised him as “very healthy” and “with a pedigree”. The case also attracted international attention. It is debatable whether pets can be seized at all. Under no circumstances may "seized items" be sold via private online accounts. In this context, the German Animal Welfare Association sharply criticized the sale of pets on Internet platforms.

The bitch was acquired by a policewoman who renamed the animal Wilma. The proceeds from the sale are said to have flowed to the Stadtkasse Ahlen. It turned out that Edda had been sick when she bought it and required several expensive eye operations. The buyer sued the Ahlen district court for damages. The case went to the Regional Court (LG) Münster, among other things because of the high value in dispute of around 20,000 euros, whereby in addition to the costs already incurred, future costs with a life expectancy of 15 years are also taken into account. An expert opinion stated that pugs were "one of the breeds most severely affected by torture breeding" and that a buyer could therefore not assume that a pug was healthy when bought. The plaintiff filed a petition for bias against the expert, which was rejected. After a complaint by the plaintiff, the case was referred to the Higher Regional Court (OLG) Münster. The OLG rejected the complaint, so that the civil proceedings at the LG Münster are continued.
