Divorce (Namibia)

Under Namibian law , a marriage can be dissolved through divorce . The basis for this is based on South African legislation, based on the Roman-Dutch Law , from the years 1935, 1939 and 1955.

As early as 2004, the Law Reform and Development Commission of Namibia (LRDC) made proposals to revise the law. These are now to be presented to the National Assembly as a legislative proposal for the first time in 2019 . [outdated]

According to the previous law, a divorce is only possible according to the principle of guilt . The reform wants to allow a divorce, as in many western states, without giving reasons according to the breakdown principle . Above all, this would significantly reduce the costs of such a divorce, which previously always required a lawyer and a court hearing.
