Retail Act

In the Federal Republic of Germany, the Retail Trade Act (Retail Act, EHG, precisely the Act on Professional Practice in Retailing of August 5, 1957, Federal Law Gazette I p. 1121) came into force on August 15, 1957 the day after its promulgation (August 14, 1957) . It required a license to operate a retail business . This depended on a certificate of competence and the reliability of the applicant.

In 1965, the Federal Constitutional Court (Bundesverfassungsgericht, Collection of Decisions, vol. 19 p. 330) ruled that the request for proof of competence is unconstitutional, unless it is a matter of trading in food, drugs or medical aids .

In 1984 the Retail Act was repealed. Since then, the regulation of the retail trade has been based on the general principles of trade law . Special regulations apply to the pharmaceutical trade .
