Right to inquire

The right of inquiry is a general special right of examination for control through the establishment of investigative committees . It is one of the central control powers of the German Bundestag and the Austrian National Council and represents in a special way the minority's right to control the government supported by the parliamentary majority.

A distinction must be made between the right to inspect by committees of inquiry and the right to set up a committee of inquiry . Study commissions are composed of members of parliament and non-parliamentarians. In contrast to investigative committees, they do not primarily serve to investigate grievances, but rather to investigate solutions and do not have the formal instruments of investigation for taking evidence such as investigative committees.

Most German state parliaments also have a minority right to set up a study commission. The required quorum for support by the MPs ranges from a third in Brandenburg, North Rhine-Westphalia and Saxony to a quarter in Berlin to a fifth in Bavaria, Hamburg and Hesse. In Bremen, Mecklenburg-Western Pomerania, Lower Saxony and Thuringia, however, a majority decision is required to set up a study commission.
