Erf (legal term)

Erf ( plural Erven ) is in Namibia , South Africa and Swaziland used legal concept, with the land in a legal sense, in the land registry ( English Deeds registry are called) are registered. The word comes from Afrikaans and corresponds etymologically to the German word Erbe .

In contrast, there are farms as agricultural land and Plot as agricultural land of less than 100 hectares.

South Africa

Section 102 of the South African Deeds Registries Act, 1937 gives the following definition (translation from English ):

Erf describes any piece of land that is registered as an Erf, parcel , parcel or property with a land registry ; this includes any defined piece of land that is not intended for use as public land in an area that is planned for settlement; this is independent of whether or not there is a formal recognition, approval or declaration as such.

Namibia

Paragraph 1 of the Namibian Deeds Registries Act, 2015 (Act No. 14 of 2015) gives an identical definition.
