First registration

The first registration (or also the day of the first registration ) is the day on which a motor vehicle is officially registered or put into operation for the first time in general and objectively unrestricted for public transport in Germany or abroad .

The first registration represents a classification under traffic law. The traffic law classification is also decisive for the assessment of motor vehicle tax ( Section 2 (2 ) of the Motor Vehicle Tax Act ). In Germany, the date of first registration is given in Part I of the registration certificate ( vehicle registration document ) under item B.

Meaning of the date

In the absence of other visible dates of the production of a vehicle, the date of first registration in Germany is generally considered to be the "birthday" of a vehicle, although it may be older than this date appears:

  1. as a result of restricted admission, e.g. B. with short-term or transfer license plates ,
  2. due to "overlay" at the dealer (see below),
  3. as a result of previous use in non-public traffic (for non-licensing racing purposes, on private property)
  4. as a result of significant modifications after accidents (e.g. new body shell / new frame)

There are court rulings that a vehicle that has remained unsold for more than two years after its manufacture can no longer be sold as a " new vehicle ".

The date of an early first registration in Germany may be associated with privileges, which are primarily based on traffic law licensing provisions under the aspect of grandfathering :

  1. Volume regulations, § 72 i. V. m. Section 49 of the Road Traffic Licensing Regulations have been tightened in phases since 1953; an "older" vehicle may be louder, which is the case with some special motorcycles, e.g. B. Harley-Davidson, is often exploited by an ancient frame being declared scrapped due to an accident and a newer vehicle is registered with the same chassis number, only to be allowed to drive an extremely loud exhaust with the pro forma- original date.
  2. Safety regulations, e.g. B. No need for seat belts and headrests (around 1965?);
  3. Emission standard , e.g. B. No need for an exhaust gas test (before July 1969 or January 1977) and classification into emission classes according to § 72 i. V. m. Section 47 Road Traffic Licensing Regulations ;
  4. Eligibility for registration as a historic vehicle (month of first registration is 30 years or more ago, plus checking for timely original condition) with reduced flat-rate vehicle tax and de facto low insurance premiums, which is not based on traffic law provisions, but actuarial and economic considerations;
  5. Eligibility for red 07 change number plates , for vehicles with min. 30 years old ( oldtimers in the legal sense according to § 2 No. 22 Vehicle Registration Ordinance , previously 20 years with continued validity according to the transitional regulation)

Particularly when it comes to the procurement of classic cars , the date of first registration is only one of several pieces of information for an exact date of its production.

In the course of 2019, the first registration of vehicles should also be possible online for the first time. The approval of the relevant ordinance by the Bundesrat and Bundestag - the ordinance is subject to approval - is still pending (status: end of September 2018).
