Educator privilege
Under a tutor privilege or educational privilege , the privilege of being parents or guardians understood about the correctness of actions or decisions to judge that the education of a child's concern.

The educational privilege for the Federal Republic of Germany results from the wording of Article 6, Paragraph 2 of the Basic Law ( Article 6 of the Basic Law ). It is one of the so-called basic rights :
“Care and upbringing of children are the natural right of parents and their first and foremost duty. The state community watches over their activities "

However, this privilege is tied to certain conditions and subject to certain restrictions: B. only as long as the parents do not grossly violate their legally defined duty of upbringing. Parents' rights in Germany are also restricted by compulsory education and the corresponding requirements of the school laws of the individual federal states: For example, legal guardians of children and young people are not allowed to declare the teacher's educational measures invalid. In order to prevent the teacher from making a decision, they only have the opportunity to complain to the school management or to raise a complaint from the supervisory authority , which the school supervisory authority then decides on (Art. 17 GG). The state educational mandate, which places the school system under the supervision of the state, derives from Article 7 (1) GG .
