Specialist lawyer for agricultural law

The specialist lawyer for agricultural law was introduced by the constitutional assembly of the Federal Bar Association (BRAK). Lawyers can acquire this title if they can prove relevant technical knowledge according to § 14 m of the specialist lawyer regulations (usually by successfully passing a so-called specialist lawyer course) and a minimum number of cases actually dealt with according to § 5 paragraph 1 letter t FAO.

Special subject-related knowledge

According to § 14 FAO special knowledge in agricultural law in the following areas must be proven:

  • 1. Agriculture-specific civil law
    • a) agricultural-specific questions of the special law of obligations (e.g. land lease law ),
    • b) Product liability law i. V. m. Basics of food law ,
    • c) Hunting and hunting leases ,
    • d) Special features of inheritance and family law ,
    • e) Special features of contract drafting and special types of contracts (e.g. agricultural cooperations, machine associations, sales and purchase contracts including terms and conditions , companies, management contracts, acquisition of farms),
    • f) Special features of labor law ,
  • 2. Agriculture-specific administrative law
    • a) Law of the approval procedure (e.g. BImSchG , BauGB , systems for processing renewable raw materials and agricultural law peculiarities of renewable energies),
    • b) basics of environmental law ,
    • c) nature and plant protection law,
    • d) fertilizer and seed traffic law, plant variety protection law,
    • e) Animal welfare, breeding and disease law,
    • f) land consolidation and land consolidation proceedings,
    • g) Real estate and land leasing law,
    • h) Wine law, forest law, hunting and fishing law,
    • i) agricultural tax law,
    • j) Special features of social security law,
    • k) State aid law, agricultural aid law, cross compliance obligations.
  • 3. Agricultural-specific administrative offenses and criminal law
  • 4. EU law specific to agriculture including its implementation in national law
    • a) EC Treaty (agriculture, environment),
    • b) EC competition law, antitrust law,
    • c) EU regulations, directives,
  • 5. Agricultural-specific procedural law
