Specialist lawyer for commercial legal protection

The specialist lawyer for commercial legal protection was introduced by the constitutional assembly of the Federal Bar Association (BRAK). Lawyers can acquire this title if they can prove relevant technical knowledge according to § 14h of the specialist lawyer regulations (usually by successfully passing a so-called specialist lawyer course) and a minimum number of cases actually processed according to § 5 para. 1 lit.o FAO.

According to § 14 h of the specialist lawyer regulations , special knowledge of commercial legal protection in the following areas must be proven:

According to Section 5 (1) (o) FAO, proof of the processing of 80 cases from at least three different areas of Section 14h No. 1 to 5 must be provided, with each of these three areas requiring at least 5 cases. A maximum of five cases may be applications for property rights, with a multiple application counting as one application. At least 30 cases must be legal proceedings, of which at least 15 must be judicial proceedings.

As of January 1, 2018, 1,172 specialist lawyers are admitted in Germany.
