Driving without a license

The driving without a license with driving license duty vehicles, u. a. Motor vehicles , is a traffic offense in Germany .

The driver is warned for not carrying the original driver's license document with him ; for this, a warning fee with a standard rate of 10 € is provided nationwide .

The driving license is the official document proving that the owner has the necessary and valid driving license for the vehicle he is driving and is therefore allowed to drive it on public roads . The document that was issued to him for the corresponding driving license class must be kept with him at all times during the journey ( Section 4 Paragraph 2 Sentence 2 FeV) and handed over to enforcement bodies upon request during inspections. Refusing to hand them over is also illegal and can lead to a warning. If the vehicle is not carried, the relevant local authority can issue and hand over an inspection request.

Differentiation from driving without a driver's license

Driving without a license is not the same as driving without a license ; the latter is a criminal offense. The driving license is not tied to the possession of the driving license. However, a special case of this offense is committed by driving without a driver's license after the license has been seized in the course of proceedings on suspicion of a criminal offense or (also temporarily) taken into official custody; the driver's license has not (yet) been withdrawn and the driver's license would actually still be valid, but this act acts like a prohibition on making use of it.
