Summer intern

Holiday interns are a form of holiday employment in Austria.

Pupils or students attend a holiday job, to complement their training , one in the curriculum or the study regulations prescribed compulsory internship in a company. For example, compulsory internships are included in the curricula of the HTLs . The curriculum provisions regulate the duration of the internship, the type of activity and the obligation to write a report.

In order to be able to work during the holidays, the holiday intern must have reached the age of 15 and completed compulsory schooling.

The focus is on the training purpose, the holiday intern is not bound by instructions and there is no work obligation, his presence is not tied to the company's working hours.

Reward

The holiday intern is not entitled to regular pay . Alternatively, pocket money can be paid. The amount of pocket money can in principle be freely agreed. However, if the pocket money is above the marginal earnings limit , there is an obligation to pay contributions to the health insurance company . If the respective collective agreements contain regulations regarding holiday interns, these are to be applied. For example, the collective agreement for the hotel and catering industry provides for a fee equal to the apprenticeship allowance.

Labor law position

The holiday intern is not an employee in the sense of labor law. The labor law provisions such as the Holiday Act, Continued Remuneration Act, Employee Act or collective agreement do not apply to the holiday intern. Summer interns are insured against accidents free of charge during the mandatory internship.
