Fireplace notice

The hearth notice is an administrative act according to the Chimney Sweep Crafts Act (SchfHwG).

Pursuant to Section 17 (1) and Section 14 (2) SchfHwG, the authorized district chimney sweeps set out to the property owners at the fireplace inspection which chimney sweeps are to be carried out for the purpose of maintaining operational and fire safety, environmental protection, energy saving and climate protection and within what period of time this has to be done (hearth notice).

The prescribed chimney sweep work results nationwide from the ordinance on small and medium-sized combustion systems (1st BImschV) and the ordinance on the sweeping and inspection of systems (KÜO) as well as any other ordinances at state level.

Objections and actions for rescission against the fireplace notice have no suspensive effect .

The costs incurred for a fireplaces notice are to be regarded as ongoing public charges on the property within the meaning of § 2 No. 1 of the Operating Costs Ordinance and can - even if they are not incurred annually - be contractually passed on to the tenants by the house owner.
