Frankfurt table

The Frankfurt table is a list introduced in the mid-1980s and used in travel law to estimate the amount of warranty claims (travel price reductions) in the event of justified travel deficiencies in a package tour.

The list is neither binding for courts nor for tour operators . It is for guidance only.

The list was drawn up by the 24th Civil Chamber of the Frankfurt Regional Court . The table was therefore created at the Frankfurt am Main Regional Court, as a particularly high number of travel contract cases was and is being negotiated there. This is due to the local residency of various medium-sized and larger tour operators (e.g. DER Touristik ) and the jurisdiction of this regional court as the court of appeal for the district court of Bad Homburg v. d. Height . The district court of Bad Homburg vor der Höhe, in turn, is often concerned with travel law, since Thomas Cook AG (with the Neckermann Reisen and Thomas Cook Reisen brands) has its headquarters there and all first-instance lawsuits against these tour operators must be brought there.

Austrian case law is also based on the values ​​in the Frankfurt table. The list is therefore not a legal source, but can serve as a useful guide for assessing travel deficiencies (OGH November 3, 2005, 6 Ob 251 / 05p; October 10, 2002, 6 Ob 11 / 02i).

Another orientation aid when evaluating travel deficiencies is the likewise non-binding Kempten travel deficiency table . This table focuses more on individual judgments and takes judgments from across Germany into account.
